i just don't see a murder charge sticking byt the definition of murder - I suspect a negligent homicide etc would be a no contest.

or perhaps they are throwing murder at him and hoping he takes a plee bargain for less.

 

Murder requires pre-meditation and intent. 3 seconds does not qualify as pre-meditation. The prosecutor is a moron if that is he card he is trying to play. If they do not indict on a lesser included charge from the get-go, and they fail to meet the criteria for murder - then he could very easily walk away entirely.
