Tips for beating speeding tickets.
 
I really hope thais is not a repost. But since we are all bikers, and we do occasionally go fast, that it might help some of us to know this. If it gets you out of a ticket, you owe the Worlok a beer!
And by the way, there are never any guarantees when your dealing with the law!


The best way to beat one is NOT to get one, so we'll deal with that first.

WHAT NOT TO DO:

1. Don't act like a chump. If you act like a belligerent idiot, you will end up with a lot more than just a speeding ticket. More likely you will end up in jail with your car impounded!

2. Do not admit guilt. Say nothing, if possible. The cop can use your admission against you in court. Better to say nothing or act dumb (see below)

WHAT YOU MUST DO:

1. Say "yes Officer, no Officer" to everything. You want this over with - fast!

2. Act stupid. It helps, even cops don't want to torture the stupid!

3. Act scared! As if the tickets means the end of your life! Again, cops waver at this point. They may not write it if they feel sorry for you.

4. Act ignorant about what you did. Even if they give you a ticket at least you didn't admit you were speeding, which they will use in court against you later.

IF YOU GET A TICKET:

1. Don't argue the situation out on the road - you will not win! You don't want them to remember you when you do go to court. SAY NOTHING - then drive away.

2. Remember everything about the situation! How much traffic, the weather, which lane you were in. Write it down if you are too stoned to remember this stuff.

AFTER YOU GET THE TICKET/PRE-TRIAL PLEA OR APPEARANCE

1. Always plead 'not guilty.' This may be a pre-trial appearance, or you may be able to send in the ticket with 'not guilty' plea. Try to delay a pre-trial appearance if possible. There will be a specified date if you have to mail in the plea.

AS THE COURT DATE APPROACHES:

1. Very important. DELAY, DELAY, DELAY!!!!!! Keep putting off that court date! You don't want to go to court! You want to make it so the cop thinks the case is so far in the past he'll never remember anything. A small story: When John Hussar, the director of The Blur of Insanity went to college he got a speeding ticket (90 mph in a 55 mph zone) from a New York State Trooper. He successfully put off going to court for two and a half years (mainly by lying about going on various trips to Europe)!! When he final did show up in court he discovered that the Trooper had been transferred out of the area! The case was immediately dismissed!
The Lesson? The longer you wait the better chance the cop won't show up!

2. Request information (optional, it can work for you, or make them want to nail you more!) Also they may or may not give you any of this depending on local laws!:

a.Copies of manufacturers names, including makes, models and serial numbers of all radar/laser guns in use by the Town/City/State Police Department.

b. Copies of manufacturers recommended maintenance for all of the above stated radar guns.

c. Copies of any manufacturer literature as it relates to the correct use, including but not limited to mounting, aiming, weather and traffic limitations, for all radar guns in use by the Town/City/State Police Department.

d. A copy of the past six months' maintenance records for all of the above stated radar guns, including, but not limited to, calibration specifications.

e. A copy of the Authorized Certification of Training, issued to the Officer who gave you the ticket, in the proper use of all radar guns in use by that Town/City/State Police Department he/she works for.

f. A copy of the patrol car assignments for the date you got the ticket.

This should give you something to work with, and also make the cop not want to show up to deal with all this crap!

COURT - A FRIGHTENING PLACE

What happens in court:

Go check in with the clerk.
See if your officer arrives, if he doesn't that will often be the end right there.
The judge will call your case.
The officer will testify first.
You then question the officer
You then call any witnesses you have
The officer can make a closing statement
You can make a closing statement
The judge decides.
1. Wear a suit, if you own one. If you look like a derelict, you will be treated like a derelict. We don't care if you think that is unfair! The world is not fair - grow up.

2. Be nice. Again, being a dick will just get you in trouble and solves nothing.

3. IT is the officers duty to prove you GUILTY. If he fails to prove your guilt the case will be dismissed.

BE confident that you will win the case!

Check the actual wording of the code you violated. If the officer fails to prove guilt in any part of the code then you should be dismissed.

BEFORE an officer can use the radar/laser reading as evidence, he has to establish a few things Jurisdiction Certification, up to date, accurate, traffic and engineering survey, radar/laser properly calibrated, tuning forks calibrated (with radar), FCC license, radar/laser unit appears on that FCC license

If the officer attempts to use the radar reading before establishing those things above, politely interrupt and say "objection your honor, inadmissible evidence."

Then tell the judge why. If the officer fails to prove your guilt at the end of his testimony don't question him, move to have the case dismissed. And explain what he failed to prove.

If the officer was moving when was his speedometer last calibrated? Have the records to see if he contradicts himself. If officer guesses your speed. throw something and ask him how fast it was going. If he is off by 3 MPH at 15 MPH speed then think about how far off he is at 35 MPH.

Were the speed limits prima facie? or Absolute? If prima facie then prove the speed you were traveling at wasn't unsafe.

ASK questions like: what color clothes was I wearing? did I have any passengers?

What was the weather like? To see how well versed the officer is.

See if you can attend traffic school in exchange for a dismissal of the charge (never bothers your insurance.)

OFTEN the worst part of a ticket is the increase in your insurance. By beating the ticket you don't have to worry about that...

Hopefully the cop won't show up - in which case you will ask that the case be dismissed - 99% of the time it will.

Anyway - there you have it. Good Luck. And if this gets you out of a ticket, dont forget my beer!

Gotta agree with Steve on this one; it's just a whole lt easier to ride responsibly. If you can't, take it to the track to work out the ego issues. LEO's are just doing their job, which isusually not a pleasant one. Don't make things worse by giving them a reason to use necessary force.

The only speeding ticket I've gotten in the last 17 years I was on my bike and a cop was behind me in an unmarked car, I didn't know it was a cop. But he was right on my ass, very very close. I had no idea it was a cop, I just thought it was some cell-phone talking idiot tail gating me on my bike which is no good, so I just eased out a bit to get some distance. I looked in my mirror to see if the guy was still tail gating and I saw blue flashing lights. Bummer. [:@]

The cop very courteously and politely wrote me up for 59 in a 45. I was nice and didn't smart off or anything, just accepted my ticket and "had a nice day". ;) The 59 in a 45 would have been 2 insurance points and would have sucked on the premium. The judge reduced it to only 9 miles over which carried no insurance points (or just 1) I can't remember but the end result was no increase.

All this with a 17 year prior driving record of no accidents or tickets. [:@]

I got nothing against cops, some of my best friends are cops, but I think I got a raw deal from that particular one. :eek:

I should have asked for all that radar specifications, calibration information, and documentation of training. ;)

Good write up....

I have been lucky and received just warnings or have had tickets dismissed except 1..... Was in Ohio, and got a ticket for doing 58 in a 55 on christmas eve. WHILE I was on the phone with 911 calling in a drunk driver. The county mounty pulls me over, doesn't believe me about the drunk driver in front of me, so I hand him my bluetooth so the a$$hole could talk to the 911 operator himself. Then hung up the phone, politely wrote me a ticket for 58 in a 55, and said he would look into the extremely drunk driver ( that could possibly kill his kids while crossing the street).

So now, I refuse to go into Ohio. LOL

ive never had a speeding ticket either... not cus i dont speed, but cus imma pimp:D:D:D i know where all the radar is in derry so i just slow down to an accecptable speed and look around.


and when i do get pulled over, for other reasons other than speeding.. i just play it cool, agree with him/her, let them know that i know what i did but give an everyday legit answer. for instance, run a red that was a yellow a couple seconds ago, cop pulls me over...

i say "hi"

her "know why i pulled you over?"

me "yup, i blew the red trying to make the yellow..."

her "where you headed?"

me "right there" (points to bowling alley across street) "im a little late to a party and in a bit of a rush, normally i'd of stopped but i second guessed myself and went for it and it turned out to be a bit shorter than i expected"

her "il be right back"

me "ok"

2 minutes later VV

her "okay im giving you a warning, i get what you were trying to do but in the end its not worth it, if you got t-boned you never would of made it to the party anyway."

me "i know, but that kinda thing dosent really run through your head when youre this close and this late."

her "i know where youre coming form, just try to be safre next time okay?

me "absobupletly"

hey "alright, drive safe"

me "thanks, and have a nice day"

her "you to."




later that day, i poured some fudge sauce on the warning and ate it. i win, no court, no $ to the state:D:D:D

Dont get me wrong, I'm not encouraging anybody to speed but my 14 is like a chained puppy at 55 mph and it is very easy to speed on that thing. And it runs so smooth that you really have no feedback from the bike except the speedo to tell you how fast you are going. I have caught myself doing 80 and had no idea that i was going that fast. People make mistakes and besides, I cant help blipping my 14 every once in a while, that's why I own it. Anybody that tells me they drive like grandma all the time just makes me wonder.

I think there is a time and place for speeding. The best answer being the track,however here in Montana I can go places where I won't see another car for hours. Thats where I like to open it up at. What pisses me off it the idiots who run through town at extreme speeds putting other peoples lives in danger. The other day a bike flew by my house doing 60+ in a 25mph zone which is full of cross streets with no stop signs.

i cant stand throttle happy retards that dont get that even if they make it today, there'll probably be radar tomorrow, and eventhough they're not gonna be there to get busted, theyre fukking over everyone else and almost demanding stricter laws and higher insurance[:@]

It's absolutely amazing; when I stopped driving like a jackass, not only did I stop getting tickets, but I stopped getting pulled over! BR, you got boned by a jackass who was pissed because he was working on Christmas Eve. Sorry for you.

nice thats cool,, so was you the guy that gave the warning for a little pot or the arresting for having a little pot lol just curious cuase ive delt with both and I much rather have cops that sees that pot is not a big deal:D

I have never been so much as tempted to try any illegal drugs... as such - I held other people to the same moral standards, and usually arrested.

However - that being said - in 6 years, I can think of only 2 or 3 times where drug use/possession was the primary charge for me. The majority of the time it was a charge I compounded onto more severe things like domestic violence/abuse, reckless driving, assault, dwi, etc. They were already going for something else - I would just put that on to help beef up the initial charge and to drive home the point that this was a "special" person to the prosecutor and judge.

ahh I totally understand,, Here in my town,, I get let go even in a road check, yeah i get serched and my pot taken but, they know me and im never in trouble, i always drive the speed limit, They know Ive worked everyday since ive been out of the service,, I just dont cause problems here and they respect that, they only serch me to make sure theres nothing else in the car like meth,, (its bad here but ****in hate it grrrrr) and if someone was watching them to see if there doin there job.. But then agian I got locked up over a bowl pack in another state but let me go and dropped everything that was a waist of my time and theres,, he locked me up> judge was pissed cuase it was just a bowl pack and i have a clean record.. but i see where your coming from there already in trouble lol
